Overview
Possession is power. Whether you are recovering your premises or defending one of the few remaining protected tenancies in Delhi, our property litigation team brings decades of forum-specific experience.
Delhi rent law is a complex tapestry — the Delhi Rent Control Act, 1958 (which protects pre-1958 tenancies and rent below ₹3,500/month), the Transfer of Property Act, 1882 (commercial and post-1958 properties), and contractual lease terms each govern different categories. We diagnose applicability and forum at the outset.
From eviction petitions before the Rent Controller (Tis Hazari) to commercial lease enforcement at the Saket Civil Court, our practice spans Defence Colony floors, Lutyens' bungalows, commercial offices in Connaught Place, and high-value retail spaces in malls.
For Landlords
- Eviction on bona fide need (Section 14(1)(e) DRC Act)
- Non-payment of rent, sub-letting, unauthorised use & change of user
- Lease termination, possession & mesne-profit suits
- Commercial premises eviction under TPA & specific contract terms
- Recovery of arrears with interest
For Tenants
- Defending eviction petitions on technical & substantive grounds
- Rent fixation & repairs under DRC Act
- Lease renewal disputes & fixed-term tenancy claims
- Defending against unjustified eviction notices
Delhi Rent Control Act vs Transfer of Property Act
DRCA applies where rent is below ₹3,500/month and tenancy is from before the relevant DRCA cutoff. TPA governs all other tenancies — including most modern commercial leases. Eviction grounds and procedures differ significantly. We first establish which regime applies before drafting strategy.
Commercial Lease Disputes
Modern commercial leases (5+5+5 year structures, lock-in clauses, escalation, exit rights) are governed by the lease itself read with TPA. Disputes arise around lock-in enforcement, security deposit refunds, exit notices, and fit-out reinstatement. We draft, litigate and arbitrate these matters across Delhi NCR commercial real estate.
