Electricity Disputes

Tariff, theft & connection litigation before regulators and courts.

Overview

Electricity disputes turn on technical inspections, regulatory compliance and constitutional rights. We represent industries, residential users and discoms before consumer forums, regulatory commissions and the High Court.

Most electricity matters in Delhi NCR involve provisional or final assessment orders under Sections 126 and 135 of the Electricity Act, 2003 — typically alleging unauthorised use or theft. The penalty regime is severe (up to twice the connected load tariff for prolonged periods), making prompt and technical defence essential.

We coordinate with electrical engineers, meter testing labs and forensic specialists to dissect inspection reports, sealing certificates and meter readings. Our DERC and BSES/Tata Power discom matters span both consumer and discom sides.

Issues We Handle

  • Unauthorised use & theft proceedings under Sections 126 & 135
  • Provisional & final assessment orders — appeals before appellate authorities
  • Tariff classification (industrial vs. commercial) disputes
  • Disconnection, reconnection & security deposit disputes
  • Open Access, captive generation & cross-subsidy advisory
  • DERC tariff orders and review petitions

Section 126 vs Section 135 — Critical Distinction

Section 126 covers 'unauthorised use of electricity' (e.g., misuse of approved load, change of category). Section 135 covers actual 'theft of electricity' (tampered meter, direct hooking) and is criminal. Procedural and penal regimes differ significantly. We frequently get Section 135 charges reduced to Section 126 where technical evidence supports it.

Forums and Appeals

  • Special Court (Electricity Theft)
  • Appellate Authority under Section 127
  • DERC for regulatory matters
  • APTEL (Appellate Tribunal for Electricity) for second appeal
  • Delhi High Court for writ challenges
